Policy and Guidelines

Key Provisions:
 

  1. Section 2(c): Defines "public servant" to include officials who can influence government decisions.

  2. Section 7: Prohibits public servants from accepting gratification (including money, gifts, or favors) for performing official duties.

  3. 3Section 12: Makes it an offense for anyone to offer or give gratification to a public servant.
     

Regulations:

1. Lobbying (Regulation) Act, 2017: A proposed bill aimed at regulating lobbying activities, but it is yet to be passed.
2. Foreign Contribution (Regulation) Act, 2010 (FCRA): Regulates foreign donations to Indian organizations, including those involved in lobbying.
3. Companies Act, 2013: Requires companies to disclose expenses related to lobbying activities.
 

Current Status:

While there is no explicit ban on lobbying, the existing regulations aim to prevent corrupt practices and ensure transparency. The proposed Lobbying (Regulation) Act, 2017, seeks to establish a framework for lobbying activities, but its passage is pending.
 

Challenges:

  1. Lack of clarity on what constitutes lobbying

  2. Insufficient transparency in lobbying activities

  3. Difficulty in distinguishing between legitimate advocacy and corrupt practices
